Terms of Use — Clothé: Clothing Care
Effective date: 1 November 2026
1. Who we are and what these terms are
These terms are an agreement between you and Darya Batura, running a sole proprietorship registered in Poland (CEIDG), NIP/VAT ID 5272976516, REGON 520385240, address ul. Piaseczyńska 51/3, 00-765 Warszawa, Poland, email [email protected] ("we", "us").
They apply together with Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) and our Privacy Policy. If these terms and Apple's agreement conflict about the licence to use the app, Apple's agreement applies unless the law says otherwise.
Nothing in these terms limits the rights you have under the mandatory consumer laws of the country where you live.
2. Who can use Clothé
You must be at least 13 years old. Cloud AI reading is for users aged 16 or older, or younger users with a parent's permission. Clothé is not intended for children.
3. What Clothé does
Clothé helps you keep a passport for your clothes, read care labels, get general care and stain guidance, compare products by fibre content and track cost per wear.
4. Free and Clothé Pro
- Free: 3 product checks in total, 1 comparison, up to 20 items and a limited number of care reminders. Free allowances don't reset.
- Pro: unlimited checks done by the app itself, up to 20 AI checks a month, unlimited items and the other features shown on the purchase screen.
- An AI check is used only when the app uses cloud AI reading and gets a result. A try that fails doesn't count. Unused AI checks don't carry over to the next month.
- We may limit clearly abusive or automated use that threatens the service. This never reduces the allowances above for normal personal use.
- Cloud AI reading isn't available in every country.
5. Subscriptions, free trial, cancellation and refunds
- Apple sells Pro subscriptions through your Apple Account. The price, the billing period and any free trial are shown on the purchase screen before you pay.
- Automatic renewal. A subscription renews automatically at the same price for the same period until you cancel. Cancel at least 24 hours before the end of the current period in iOS Settings › [your name] › Subscriptions, or with Manage Subscription in the app. You keep Pro until the end of the period you paid for.
- Free trial. Offered once, as Apple's rules allow, and only where the purchase screen shows it. Unless you cancel at least 24 hours before the trial ends, the paid period starts.
- Price changes. Apple will tell you in advance and, where required, ask for your consent.
- Refunds are handled by Apple: https://reportaproblem.apple.com. This doesn't limit your statutory rights.
- [EU/EEA, UK] You have the right to withdraw from the contract within 14 days. If you asked us to start providing digital content immediately and confirmed that you lose this right, the right may end as the law allows. Withdrawal for App Store purchases follows Apple's terms.
6. Care guidance: please read
- Care guidance in Clothé is general information based on care-label standards and public sources. It can't account for every fabric, finish, dye or cleaning product.
- Always follow your item's care label and the instructions on the product you use. If the label says something different, follow the label.
- Test any product on a hidden spot first.
- Use one product at a time and never mix cleaners. Work in a ventilated room, protect your skin and eyes, and keep products away from children and pets.
- For valuable, delicate or sentimental items, a professional cleaner is the safest choice.
- Label recognition and AI can make mistakes. Check the result before you save it.
We work to keep our guidance safe and conservative, but you decide what to do with your items. This section doesn't exclude any liability that the law doesn't allow us to exclude (see section 10).
7. AI reading
- It works only with your permission. Details are in the Privacy Policy.
- Results are suggestions, marked Suggested until you confirm them.
- Please don't send photos that show faces, documents or other personal information.
8. Your content and product links
- The photos, notes and data you add are yours. We get no rights to them except what the app needs to work on your device and, with your permission, for cloud AI reading.
- Only import pages and images you're allowed to view. Store images are kept for your personal use only.
- Comparisons and ratings of fabric properties are information, not advertising and not a guarantee about third-party products.
9. Our content
The texts, guides, illustrations, rule sets and design of Clothé belong to us or are used under licence. You may use them in the app for personal, non-commercial purposes. You may not copy the rule sets or content in bulk, decompile the app or get around its limits, except where the law allows. Third-party components are listed in About › Acknowledgements. Brand names of cleaning products belong to their owners and are used only to describe them; we are not affiliated with them.
10. Liability
- We do not exclude or limit liability for death or personal injury caused by our negligence, for intent or gross negligence, for fraud, or for anything else that cannot be excluded or limited under applicable law.
- [EU/EEA, UK] Digital content must conform to the contract, and you have statutory remedies if it doesn't (Directive (EU) 2019/770; UK Consumer Rights Act 2015). These terms don't limit them.
- [Australia] Nothing in these terms excludes, restricts or modifies the consumer guarantees under the Australian Consumer Law.
- [New Zealand] Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
- Otherwise, to the extent the law allows, we are not liable for losses that were not reasonably foreseeable, and our total liability is limited to the amount you paid for your subscription in the 12 months before the event.
11. Changes to the service and these terms
We may improve the app. We won't make material changes that reduce paid features during a period you've paid for without your agreement, unless the law, security or the unavailability of a third-party service requires it; in that case you may cancel. We'll tell you about changes to these terms in the app in advance.
12. Ending
You can stop using Clothé at any time: cancel your subscription and delete the app and your data (Delete All Data).
13. Governing law and disputes
- Polish law governs these terms. If you are a consumer, you keep the protection of the mandatory laws of the country where you live (Rome I Regulation, Art. 6), and you may bring a claim in the courts where you live where the law allows.
- There is no mandatory arbitration and no class-action waiver for consumers in the EU/EEA, the UK, Canada (including Québec, CPA s. 11.1) or any other country where they are not allowed.
- [EU] Please contact us first at [email protected]. You can also contact the Polish consumer ombudsman (rzecznik konsumentów), UOKiK (https://uokik.gov.pl) or the European Consumer Centre in your country (ECC-Net).
